These Terms of Service ("Terms") govern your access to and use of the website located at https://www.nackbh.com (the "Site"), operated by Nack Behavioral Health, LLC ("Nack," "we," "us," or "our"), a mental health intensive outpatient program serving college students with locations in California. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Acceptance of Terms
By accessing, browsing, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. We may update these Terms from time to time as described in Section 13 below. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
2. Description of the Site and Services
The Site provides general information about Nack's intensive outpatient program (IOP) services, our clinical team, program locations, and related resources for prospective clients, current clients, families, referral sources, and the public. The Site may also allow visitors to submit inquiries, request information, or begin an intake process through online forms.
The Site itself does not provide clinical treatment, diagnosis, therapy, or crisis intervention. Any treatment relationship between you and Nack is established only after direct clinical intake, assessment, and agreement to program-specific consent and treatment documents, not through use of this Site.
3. No Medical Advice; No Provider-Client Relationship
Content on the Site, including program descriptions, clinical team biographies, blog posts, articles, or other educational materials, is provided for general informational purposes only and does not constitute medical or mental health advice, diagnosis, or treatment. It is not a substitute for professional clinical judgment or an individualized evaluation by a licensed provider.
Submitting an inquiry, intake form, or contact request through the Site does not, by itself, create a provider-client or therapeutic relationship between you and Nack or any Nack clinician. That relationship begins only once we have completed appropriate intake procedures and you have signed applicable consent for treatment documentation.
4. Eligibility
The Site is intended for use by individuals who are at least 18 years of age, or by parents, guardians, providers, or authorized representatives acting on behalf of a prospective client. If you are submitting information on behalf of a minor or another individual, you represent that you have the authority to do so.
5. Use of Information You Submit
If you submit personal information through a contact form, intake form, or similar feature on the Site, such as your name, contact information, or details about your presenting concerns, we will use that information to respond to your inquiry, evaluate program fit, and, where applicable, begin the intake process, consistent with our Privacy Policy and applicable law, including HIPAA and 42 CFR Part 2 where relevant.
Information submitted through the Site is not encrypted end-to-end as clinical record-keeping systems may be, and you should avoid including highly sensitive clinical detail in general contact forms. Please see our Notice of Privacy Practices for information about how protected health information is handled once you become a client.
6. Acceptable Use
You agree not to use the Site to:
- Violate any applicable federal, state, or local law or regulation;
- Submit false, misleading, or fraudulent information;
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
- Interfere with or disrupt the Site's security, servers, or networks;
- Attempt to gain unauthorized access to any portion of the Site, other users' data, or Nack's systems;
- Use any automated system (bots, scrapers, crawlers) to access the Site without our prior written consent;
- Upload or transmit viruses, malware, or other harmful code;
- Use the Site to harass, threaten, or harm any person, including Nack staff or other users.
We reserve the right to restrict, suspend, or terminate your access to the Site, without notice, for conduct that we believe violates these Terms or is otherwise harmful to Nack, other users, or third parties.

"Nack" and associated logos and marks are trademarks of Nack Behavioral Health, LLC. Nothing on this Site grants you any license or right to use those marks without our prior written permission.

The Site may contain links to third-party websites, resources, or services (for example, insurance verification portals, external mental health resources, or professional directories) that are not owned or controlled by Nack. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party site. TO THE FULLEST EXTENT PERMITTED BY LAW, NACK BEHAVIORAL HEALTH, LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.
13. Changes to These Terms
